General Terms and Conditions of AGON PARTNERS SOLUTION GmbH for the use of the digital analysis Abuse of Relative Market Power
1. Scope of application
These General Terms and Conditions apply to the use of the digital analysis of abuse of relative market power of AGON PARTNERS SOLUTION GmbH , Korporationsweg 9B, 8832 Wilen b. Wollerau SZ, Switzerland, hereinafter referred to as “AGON SOLUTION”.
2. Offer and Conclusion of contract
The offer is aimed at companies in Switzerland
By clicking on the “Buy now” button, you place a binding order. The purchase contract is only concluded once payment has been made.
3. Subject matter of the Contract
The analysis is conducted through an interactive questionnaire. By selecting the most relevant answers, you provide the data required for the assessment. The more carefully you answer the questions, the more accurate the results will be. The analysis digitally evaluates the behavior of a specific business partner or whether your company might be affected by an abuse of relative market power. The results of the analysis are displayed digitally, and you can have them sent to you via email.
The analysis cannot replace comprehensive advice from a lawyer specializing in antitrust law. It is intended to quickly and cost-effectively assess whether further consultation with an antitrust expert and/or a report to the Swiss Competition Commission is advisable in a specific case.
4. Prices, Conditions and Payment
The prices applicable for the evaluation include statutory value-added tax. The applicable currency is Swiss Francs (CHF).
Payment is made exclusively via PayPal. The PayPal terms and conditions apply accordingly.
If you require an invoice, please send us a brief note so that we can email it to you. In this case, please provide your contact details.
If you subsequently seek legal advice from AGON SOLUTION following the digital analysis, the costs for the digital analysis will be credited to you.
5. Data protection and Data processing
The data collected in the questionnaire is stored anonymously and may be used by AGON SOLUTION for statistical evaluations. All data is deleted after one year.
If you wish to receive further consultation following the evaluation, please provide your contact details, as this is the only way we can associate your answers with you. Any contact details you provide will be stored in a machine-readable format and processed as necessary within the scope of the contractual relationship. We treat your data confidentially.
If you subscribe to the newsletter, we reserve the right to share your data within the AGON group (agon-partners.ch) for this purpose. No data will be shared with other third parties.
6. Warranty and Liability
The digital analysis applies the criteria derived from current legislation and case law to assess the indicators and is continuously evaluated and improved with the utmost care.
Nevertheless, it cannot be ruled out that, in individual cases, there may be an incorrect assessment of market power. The use of the digital analysis does not replace comprehensive legal advice from a lawyer. Claims for damages against AGON SOLUTION are excluded unless the damage was caused intentionally or through gross negligence.
In the event of malfunctions or system failures, AGON SOLUTION strives to resolve them as quickly as possible. AGON SOLUTION excludes all liability for damages incurred by the customer due to the unavailability of the system operated by AGON SOLUTION.
7. Applicable law and Place of jurisdiction
The legal relationship is governed by Swiss law. Both parties agree to seek direct contact primarily in the event of damage or complaints. The exclusive place of jurisdiction for all disputes is the registered office of AGON SOLUTION.
8. Severability Clause
Should any provision of these general terms and conditions be invalid, the remainder of the contract shall remain effective. In place of the invalid provision, the relevant statutory provisions shall apply.
